Terms of Service

By downloading, installing, or using the Bentara mobile application or website (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. Bentara is operated by Casting Guild ("we", "us", or "our"). These Terms constitute a legally binding agreement between you and Casting Guild.

You must be at least 13 years of age to use Bentara. By using the Platform, you represent and warrant that you are of legal age to form a binding contract under Malaysian law. If you are using the Platform on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

3.1 Registration

You must create an account to access most features of Bentara. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at hello@Bentara.io if you suspect unauthorized access to your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or harm other users or service providers.

4.1 Acceptable Use

You agree to use Bentara only for lawful fishing-related purposes. You must not: • Post false, misleading, or harmful content • Harass, abuse, or threaten other users or service providers • Upload content that infringes on any copyright, trademark, or other intellectual property rights • Use the Platform to transmit spam or unsolicited communications • Attempt to reverse engineer, hack, or disrupt the Platform

4.2 Community Content

Catch logs, photos, comments, and reviews that you post on Bentara are your responsibility. By posting content, you grant Bentara a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content within the Platform for the purpose of operating the community features.

4.3 Fishing Laws

You are solely responsible for complying with all applicable Malaysian federal and state fishing regulations, licensing requirements, protected species rules, and conservation laws. Bentara does not assume any liability for your compliance with fishing laws.

5.1 Provider Listings

Boat captains, kolam pancing owners, kelong operators, and tournament organizers who list their services on Bentara ("Providers") represent that all information in their listing is accurate, lawful, and up to date.

5.2 Provider Responsibilities

Providers are solely responsible for: • The safety and quality of their services • Holding all necessary business licenses and permits • Compliance with Malaysian maritime and safety regulations • Delivering services as described in their listing • Resolving disputes with anglers directly

5.3 Bookings

Bentara facilitates booking inquiries between anglers and providers. We are not a party to any transaction or booking agreement between users and providers. All bookings are ultimately between the angler and the provider.

6.1 Free Platform

Basic use of the Bentara Platform — including discovering spots, logging catches, and submitting booking inquiries — is free of charge.

6.2 Donations

Bentara may offer a voluntary donation ("Buy Me a Coffee") feature to support ongoing development. All donations are voluntary and non-refundable.

6.3 Future Premium Features

We may introduce optional paid features in the future. Any charges will be clearly communicated before you are asked to pay.

The Bentara name, logo, app design, and all original content on the Platform are the intellectual property of Casting Guild and are protected under Malaysian law. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission. The "Bentara" and "Casting Guild" names and logos are trademarks of Casting Guild.

8.1 Platform Provided "As Is"

Bentara is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

8.2 Marine & Weather Data

Tide predictions, weather forecasts, and marine data provided by Bentara are for informational purposes only. Always exercise your own judgment and consult official sources before going to sea. Bentara is not liable for any injury, loss, or damage arising from reliance on our marine data.

8.3 Limitation of Liability

To the maximum extent permitted by Malaysian law, Casting Guild shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or any services booked through it.

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice in the app or via email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
